These Terms and Conditions govern your use of our website, services, and supply and order processes, whether placed through the website or via our authorized sales channels.

By using the website or placing any order, you acknowledge and agree to be bound by these Terms and Conditions.

1. Service Description and Transaction Nature (B2B) Kuwait Gourmet operates as a specialized supplier of raw materials, production supplies, and equipment for the confectionery, bakery, chocolate, restaurant, and hospitality sectors in the State of Kuwait. Services and quotations are primarily directed towards commercial and professional activities (companies, factories, restaurants, cafes, bakeries, and chefs).

2. Account Setup and Orders The client is obligated to provide accurate and complete business information (trade name, contact details, address, and commercial registration number, if requested). Quotations are valid only for the period specified in the quotation and are subject to stock availability and fluctuations in global supply chain prices. An order is not considered confirmed and final until official confirmation is received from the sales department or a payment confirmation/endorsement notice is received.

3. Prices and Payment Terms All prices quoted are in Kuwaiti Dinars (KWD) unless otherwise stated. Payments are processed according to agreed-upon mechanisms (electronic payment, bank transfer, or approved credit facilities under special supply contracts). The company reserves the right to adjust prices for products not confirmed by pre-orders at any time based on market changes.

4. Delivery and Cold Chain We are committed to delivering products according to refrigerated transport standards appropriate for the nature of raw materials (such as chocolate, butter, and creams) to maintain their quality and safety. The customer is responsible for providing a suitable receiving location and a storage environment that meets specifications upon receipt of the shipment. The recipient is required to inspect the shipment upon arrival and sign the receipt notice.

5. Returns, Exchanges, and Damage Due to the sensitive nature of food products, bakery supplies, and chocolates, and in accordance with food safety regulations: Returns and exchanges of opened food items or those that have left the approved cold chain are not accepted. In the event of visible damage during transport or non-compliance with specifications, we must be notified within 24 hours of receipt, along with photos and supporting documentation, to process a replacement or refund.

6. Intellectual Property Rights All website content, including text, logos, designs, product images, and catalogs, is the exclusive property of Kuwait Gourmet and protected by intellectual property laws. It may not be copied or used for commercial purposes without prior written permission.

7. Limitation of Liability The company makes every effort to ensure that all raw materials conform to standard specifications and disclaims liability for any misuse, improper storage, or incorrect application of products after receipt.

8. Applicable Law and Jurisdiction These Terms and Conditions shall be governed by and construed in accordance with the laws and regulations of the State of Kuwait, and the Kuwaiti courts shall have exclusive jurisdiction over any dispute arising therefrom.
